"...And Justice for All": discursos, personagens e teorias do direito no cinema americano

Abstract

Resumo: Este artigo problematiza a relação entre Direito e Cinema a partir da análise da construção das personagens no filme “...And Justice for All” (1979), de Norman Jewison. Trabalha com a hipótese de que o filme, que teve grande repercussão na sociedade americana, contribuiu para o acirramento da crítica ao paradigma positivista do Direito naquele país. Para isso, procura relações entre a caracterização das personagens no filme e sua adesão a determinadas concepções (teorias) e práticas do Direito, propondo a análise de seus discursos. O escopo teórico do trabalho se fundamenta nos estudos sobre as relações entre Direito, Cinema e Literatura, e na compreensão das Teorias do Direito enquanto práticas-discursivas tendo como ponto de partida metodológico a obra “El Derecho de La sociedad”, de Niklas Luhmann, e o método de análise de discursos proposto por Peter Shöttler.

Abstract: This article discusses the relationship between Law and Film based on analysis of the construction of the characters in the film "... And Justice for All" (1979), directed by Norman Jewison. It assumes the hypothesis that the film, which had great impact on American society, contributed to the intensification of criticism of the positivist paradigm of law in that country. To do so, it searches relations between the construction of the characters in the film and their adherence to certain theories and praxis of law, proposing the analysis of their speeches. The theoretical scope of work is based on studies of the relationship between Law, Film and Literature, assuming theories of law as discursive-practices. The methodological starting point is the work, "El Derecho de la sociedad," of Niklas Luhmann, and the method of analysis of discourse proposed by Peter Shöttler.
